END USER LICENSE AGREEMENT (EULA)

This End User License Agreement (“Agreement”) is a legal agreement between you (“End User” or “User”) and Daliborka Kekeljevic PR Ophionic, Novi Sad, Serbia (“Licensor”), governing the download, installation, and use of the DeckMania software (“Software”).
By downloading, installing, registering, or using the Software, you acknowledge that you have read and agree to be bound by the terms of this Agreement, as well as the accompanying Terms of Service available at www.deckmania.com.
If you do not agree to these terms, do not download, install, or use the Software.
1. LICENSE GRANT
Licensor grants the End User a non-exclusive, non-transferable, revocable license to install and use the DeckMania Software in accordance with the User’s Membership level (“Lite” or “Pro”), as defined in the Terms of Service.
- DeckMania Lite Membership (Free):
Grants limited access to core features of the Software for evaluation purposes.
Availability of Lite Membership is at the discretion of the Licensor and may be modified or discontinued at any time. - DeckMania Pro Membership (Paid Annual Membership):
Grants access to all professional features, extended components, and online services.
The Pro Membership is valid for one year from the date of purchase and does not renew automatically.
Prior to expiration, the User will receive a notification inviting renewal through the website.
The Software requires online verification to validate Membership status and activate corresponding functionality.
This license does not transfer ownership of the Software.
2. LICENSE RESTRICTIONS
The End User shall not:
a) Modify, reverse engineer, decompile, or disassemble the Software.
b) Circumvent or disable online verification mechanisms.
c) Distribute, sublicense, rent, lease, or lend the Software to any third party.
d) Use the Software for any illegal, unethical, or unauthorized purpose.
e) Remove or alter any copyright, trademark, or proprietary notices.
Any violation of these restrictions constitutes a material breach of this Agreement and will result in immediate termination of the license.
3. OWNERSHIP AND INTELLECTUAL PROPERTY
The Software is licensed, not sold.
All rights, titles, and interests, including but not limited to copyrights, trademarks, patents, and trade secrets, remain the exclusive property of Daliborka Kekeljevic PR Ophionic.
This Agreement grants no ownership rights to the User.
The DeckMania name, logo, and all associated intellectual property are protected by applicable laws and international treaties.
4. MEMBERSHIP ACCESS AND PAYMENTS
The use of DeckMania Pro features requires an active Pro Membership, which is purchased directly on www.deckmania.com through secure credit or debit card payment processing.
- Membership access is valid for one year from the date of payment.
- The Membership will not renew automatically; the User must manually extend it if they wish to continue using Pro features.
- If the Membership expires and is not renewed, the User’s account will revert to Lite access (if available).
All payments are subject to the Terms of Service and are final and non-refundable, except in cases explicitly stated therein.
5. DISCLAIMER OF WARRANTIES
The Software is provided “AS IS” without warranty of any kind, express or implied.
Licensor does not warrant that the Software will meet the User’s requirements or operate uninterrupted or error-free.
The User assumes all responsibility for use, performance, and results obtained from the Software.
6. LIMITATION OF LIABILITY
In no event shall Daliborka Kekeljevic PR Ophionic be liable for any direct, indirect, incidental, special, or consequential damages arising out of or related to the use or inability to use the Software, even if the Licensor has been advised of the possibility of such damages.
Liability shall in no case exceed the amount paid for the Pro Membership in the 12 months preceding the claim.
7. TERMINATION
This Agreement is effective from the date of installation or first use and remains in effect until terminated.
Licensor may terminate this Agreement immediately if the User fails to comply with its terms.
Upon termination, the User must cease all use of the Software and delete all copies from their devices.
Membership access may also terminate automatically upon expiry or revocation of verification rights.
8. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the Republic of Serbia, without regard to its conflict of law principles.
Any disputes arising from or related to this Agreement shall be subject to the exclusive jurisdiction of the competent courts in Novi Sad, Serbia.
9. CHANGES TO THIS AGREEMENT
Licensor reserves the right to modify this Agreement at any time.
Updated versions will be posted on www.deckmania.com, and continued use of the Software after publication of such changes constitutes acceptance of the revised terms.
